Thank you for choosing to be part of our community at Schrocken Inc., doing business as Mosymphony (“Mosymphony”, “we”, “us”, or “our”). We provide our customers with ways to manage contract manufacturing with the same operating visibility, control and compliance as internal manufacturing. (hereinafter referred to as the “Services”). These Services are part of Schrocken Inc. and can be accessed at our website (such as schrocken.com and schrocken.io), mobile applications (Apps), and/or any related services, sales, marketing or events (hereinafter collectively referred to as the “Sites”). This Privacy Policy describes and explains our policies and procedures on the collection, use and disclosure of your personal data/information when you use our Services and/or our Sites. We are committed to protecting your personal information and your right to privacy and shall use and/or disclose your personal data/information only in the manner as described under this Privacy Policy. When you visit our Sites and use our Services, you trust us with your personal data/information and voluntarily permit us to use and disclose your personal data/information in the manner as described under this Privacy Policy. - All payment data is stored by our payment processor and you should review its privacy policies and contact the payment processor directly to respond to your questions;
- All personal information that you provide to us must be true, complete and accurate, and you must notify us of any changes to such personal information;
- If you wish to change our access or permissions to the information collected through Apps, you may do so in your device’s settings
How do we use your information?
We need to store your information in order to run the infrastructure and provide you with the Services. We use your information collected in the manner as mentioned above, for a variety of business purposes described below. We process and use your information for the below-mentioned purposes and processing ground, in reliance on our legitimate business interests (“Business Purposes”), in order to enter into or perform a contract with you (“Contractual”), with your consent (“Consent”), and/or for compliance with our legal obligations (“Legal Reasons”).
a) Create an Account: To enable you to create an account with us in order to access and avail the Services including support as and when required;
b) Send administrative information to you: We may use your personal information to send you information related to products, services, new features and/or any changes to our terms, conditions, and policies;
c) Fulfill and manage your orders: We may use your information to fulfil and manage your orders, payments, returns, and exchanges made through the Sites
d) Protect our Sites: We may use your information as part of our efforts to keep our Sites safe and secure (for example, for fraud monitoring and prevention);
e) Enable user-to-user communications: We may use your information in order to enable user-to-user communications with each user’s consent.
f) Compliance: We may use your information in order to comply with with the statutory policies, rules, regulations and/or to enforce our terms, conditions and policies;
g) Legal: We may use your information to statutory and legal purpose including but not limited to responding to legal notices, issuing legal notices, data inspection, statutory or judicial disclosure as an when demanded by a judicial and/or quasi-judicial body, any other legal purpose.
h) Other Business Purposes: We may use your information for other business purposes, such as data analysis, identifying usage trends, determining the effectiveness of our promotional campaigns and to evaluate and improve our Sites including Apps, products, services, marketing and your experience.
i) Security and Operations: We may use your information to maintain security and operation of our Sites and for our internal analytics and reporting purposes
Will your information be shared with anyone?
While we are committed to protecting your personal information and your right to privacy, you agree and acknowledge that we need to disclose, process and share your information with limited third parties and statutory bodies in order to comply with the applicable laws, to protect your rights and/or to fulfil our business obligations.
We do not sell or rent personal information to any third party entities. We limit the disclosure of the Personal Information to certain circumstances, as provided below::
a) Legitimate Business Interests: We may process and disclose your data to offer you Services, run the infrastructure for providing you with the Services when it is reasonably necessary to achieve our legitimate business interests and where we have entered into a contract with you to fulfil the terms of our contract.
b) Legal Obligations: We may disclose your information where we are legally required to do so in order to comply with applicable law, governmental requests, a judicial proceeding, court order, or legal processes, such as in response to a court order or a subpoena (including in response to public authorities to meet national security or law enforcement requirements);
c) Vital Interests: We may disclose your information where we believe it is necessary to detect, investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, identity thefts, situations involving potential threats to the safety of any person and other illegal activities, correlate or map related accounts to prevent misuse of our products & services and/or as evidence in litigation in which we are directly or indirectly involved;
d) Business Transfers: We may share or transfer your information in connection with, or during negotiations of any merger, sale of company assets, financing, restructuring of business or re-organization, and/or acquisition of all or a portion of our business by another company;
e) Third-Party Advertisers: We may use third-party advertising companies to serve ads when you visit the Sites including Apps. These companies may use information about your visits to our Website(s) and other websites that are contained in web cookies and other tracking technologies in order to provide advertisements about goods and services of interest to you;
f) Business Partners: We engage a number of vendors, consultants, contractors and take the support of our group companies or affiliates (hereon referred to as our Partners) in ruining the operations of our business including for providing you Services. Our Partners provide a host of services including contact information verification, payment processing, customer service, website hosting, data analysis, infrastructure provision, IT services, and other similar services. These Partners play a key role in the seamless delivery of our products and services to you. These Partners and their employees operate under a contract and strict security & confidentiality restrictions. We may provide our partners access to your information through our systems or may share your information with them to enable them to provide their services to you;
g) Customer Initiated Sharing: Whenever you request us to share your information with a third-party website or application (for example, log in to a third party using your ID), we will provide a fresh notice and obtain consent from you regarding the details of the information that will be shared, before sharing the same. In such a case, we will not be in control of the information (shared with the third party website/application or data generated based on your usage on that website/application) and our Privacy Policy will not be applicable for any such use, access etc. Any processing, use, sharing of Information provided by you to such third party website/application shall be as per the respective privacy policy of such applications and websites. You shall read and provide consent to the third party’s privacy policy before requesting us to share the information;
h) Other Users: When you share personal information (for example, by posting comments, contributions or other content to the Sites or Apps) or otherwise interact with public areas of the Sites or Apps, such personal information may be viewed by all users and may be publicly distributed outside the Sites or Apps in perpetuity. Similarly, other users will be able to view descriptions of your activity, communicate with you within our Sites or Apps, and view your profile.

A cookie is a small text file that is placed on your computer, mobile phone, or other devices when you visit a website.
We use essential operational cookies because they are necessary to allow us to operate the Services. Is your information transferred internationally?
Our servers are located in United States. If you are accessing our Sites or Apps from outside United States, please be aware that your information may be transferred to, stored, and processed by us in our facilities and by those third parties with whom we may share your personal information (see “WILL YOUR INFORMATION BE SHARED WITH ANYONE?” above), in and other countries.

EU-U.S. Privacy Shield Framework:
In particular Schrocken Inc. complies with the EU-U.S. Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union to the United States and has certified its compliance with it. As such, Schrocken Inc. is committed to subjecting all personal information received from European Union (EU) member countries, in reliance on the Privacy Shield Framework, to the Framework’s applicable Principles. Schrocken Inc. is responsible for the processing of personal information it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf.
With respect to personal information received or transferred pursuant to the Privacy Shield Framework, Schrocken Inc. is subject to the regulatory enforcement powers of the U.S. FTC. In certain situations, we may be required to disclose personal information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.
